
TERMS OF USE, PAYMENTS & REFUND POLICY
1. DEFINITIONS
“Company” means Wattmotive EV Tech Private Limited, incorporated under the Companies Act, 2013, operating under the brand Chargeworks.
“User”, “You” means any individual or entity accessing or using the Services.
“Services” include electric vehicle charging services, EVSE access, software platforms (mobile/web applications), dashboards, wallets (if applicable), and related offerings provided by Chargeworks.
“EVSE” means electric vehicle supply equipment deployed or integrated on the Chargeworks platform.
2. ACCEPTANCE OF TERMS
By accessing or using the Chargeworks website or application, you confirm that you have read, understood, and agree to be bound by these Terms, the Privacy Policy, and all supplemental policies published by Chargeworks from time to time.
If you do not agree, you must discontinue use of the Services immediately.
3. SCOPE OF SERVICES & AVAILABILITY
Chargeworks enables discovery, access, monitoring, and payment for EV charging services across participating charging stations.
Service Availability
Chargeworks does not guarantee uninterrupted or error-free availability of charging services. Charging sessions may be impacted by factors beyond the Company’s control, including but not limited to:

Power supply disruptions from the electricity grid

Telecom or internet connectivity issues
-
Backend system or OCPP communication failures
-
EVSE maintenance, upgrades, or faults
-
Force majeure events or government actions
Chargeworks shall not be liable for losses arising from such service interruptions.
4. USER RESPONSIBILITY & VEHICLE COMPATIBILITY
You acknowledge and agree that:

Charging speed, session duration, and termination may be controlled by the vehicle’s onboard systems (BMS).

Not all EVs are compatible with all chargers or connectors.
-
The User is responsible for selecting the correct charging station, connector type, and ensuring vehicle compatibility.
Vehicle-Side Disclaimer & Fire Safety
Chargeworks shall not be responsible or liable for:

Vehicle error codes or warnings.
-
Reduced charging speed or early session termination.
-
Battery degradation or vehicle malfunction.
-
Vehicle Fire: In the event of a vehicle fire, damage, or thermal runaway caused by a vehicle malfunction, battery defect, or onboard system failure during or after a charging session, Chargeworks shall not be held liable.

Any EV-side faults occurring during or after charging.
5. USER ACCOUNTS & CONDUCT
Users must provide accurate information and are responsible for all activity conducted through their account.
Account Closure Procedure
A User may request to close their account provided the following conditions are met:

Verified Status: The account information must be fully verified.
-
No Active Sessions: There must be no active charging session at the time of the request.

Balance: The account may be closed regardless of wallet balance; however, specific refund rules apply (see Section 8).
Processing & Restrictions

Closure Timeline: Once a closure request is submitted, it takes 2 working days to formally close the account.

Login Restriction: During this 2-day processing window, you are not permitted to log in to the app.

Confirmation: You will receive an email confirmation once the account is officially closed.

Cooling-Off Period: To prevent platform abuse, once an account is closed, the mobile number associated with that account cannot be used to register a new account for a period of 1 year from the date of closure.

6. PAYMENTS & WALLET
Payment Processing

Payments are processed via RBI-authorized banks and payment aggregators

Chargeworks does not store card, UPI, or banking credentials
-
Users are bound by the applicable terms of the payment service provider
Chargeworks shall not be liable for payment failures attributable to banks or payment gateways.
Wallet

Wallet balances are closed-loop, non-transferable, and non-interest-bearing
-
Wallet funds may be used only for Chargeworks services
-
Wallet balances are refundable only as per the Refund Policy
7. PRICING & TARIFFS
Charging tariffs, applicable taxes, and fees are displayed prior to session initiation.
Prices may vary based on:

Charger type
-
Location
-
Electricity costs
-
Time-of-use or network conditions
Chargeworks reserves the right to revise tariffs at any time.
8. REFUNDS & FAILED SESSIONS
Standard Session Refunds
Refunds for failed sessions (system fault, duplicate debit) will be credited to the original payment method within 7 working days.
Wallet Refund Upon Account Closure
If you choose to close your account and have a remaining positive wallet balance:

Wait for the official account closure email (sent after 2 working days).

After receiving the confirmation, email support@chargeworks.in.

You must attach a scanned copy of a cancelled cheque where the name on the cheque matches the name on the verified Chargeworks account.
-
Refunds will be processed via bank transfer only after verification of the provided documents.
9. REVIEWS & FEEDBACK
Users may submit ratings, reviews, or feedback.
Chargeworks does not endorse user reviews and reserves the right to remove content that is:

False or misleading
-
Abusive, defamatory, or unlawful
-
Not based on actual service experience
By submitting feedback, you grant Chargeworks a non-exclusive, royalty-free license to use such content for service improvement and communication.
10. THIRD-PARTY SERVICES
The platform may integrate third-party services such as payment gateways, maps, or OEM systems.
Chargeworks is not responsible for the availability, accuracy, or performance of third-party services, which are governed by their respective terms.
11. MODIFICATION OF SERVICES
Chargeworks may modify, suspend, or discontinue any part of the Services, including features, pricing, or availability, for operational, technical, or regulatory reasons.
12. DISCLAIMER & LIMITATION OF LIABILITY
Services are provided on an “as is” and “as available” basis.
To the maximum extent permitted by law:

Chargeworks disclaims all implied warranties

Aggregate liability shall not exceed the value of the disputed transaction
Nothing herein limits liability for fraud, willful misconduct, or statutory obligations.
13. FORCE MAJEURE
Chargeworks shall not be liable for delays or failures caused by events beyond reasonable control, including natural disasters, grid outages, government actions, or network failures.
14. GRIEVANCE REDRESSAL
For service, payment, or refund-related grievances:

15. DISPUTE RESOLUTION
Disputes shall first be resolved amicably.
If unresolved, disputes shall be referred to arbitration under the Arbitration and Conciliation Act, 1996.

Claims relating to intellectual property or fraud may be pursued before courts of competent jurisdiction.
16. GOVERNING LAW
These Terms shall be governed by the laws of India. Courts at Bengaluru, Karnataka shall have jurisdiction, subject to arbitration.
