1. DEFINITIONS

“Company” means Wattmotive EV Tech Private Limited, operating under the brand Chargeworks.
“User”, “Client”, “You” refers to the individual or entity accessing the Services.
“Services” means EV charging solutions, mobile/web applications, and related offerings provided by Chargeworks.

2. ACCEPTANCE OF TERMS

By accessing the website or application, you agree to be bound by these Terms and our Privacy Policy. Do not continue to use Chargeworks if you do not agree to all terms and conditions stated herein.

3. COOKIES

We employ the use of cookies. By accessing Chargeworks, you consent to the use of cookies in accordance with our Privacy Policy.
Cookies help personalize your experience and may also be used by affiliates or advertising partners.
Most browsers allow you to refuse cookies or alert you when cookies are sent; however, blocking cookies may affect Service functionality.

4. LICENSE & INTELLECTUAL PROPERTY

Unless otherwise stated, Chargeworks and/or its licensors own the intellectual property rights for all material on the website and app.
All rights are reserved. You may access content for your personal use subject to restrictions set in these Terms.
You must not:
- Republish, sell, rent, or sub-license material from Chargeworks
- Reproduce, duplicate, or copy content without prior consent
- Redistribute content from Chargeworks for commercial purposes

5. USER ACCOUNTS

To use certain Services (such as starting a charging session), you must register an account with accurate details.
You are responsible for safeguarding your login credentials and all activity under your account.
Any unauthorized use or suspected breach must be reported immediately.
You may request deletion of your account via the app. Upon deletion:
All user data will be removed from active systems, except as legally required.
Any wallet balance will be refunded to your provided UPI account within 7 working days.
The linked phone number will be restricted for 12 months before a new account may be opened.

6. PAYMENTS & CHARGING SERVICES

All fees are displayed before initiating a charging session.
Payments are processed through third-party gateways.
Payments are non-refundable, except in cases of failed sessions, double debits, or Company error.
Refunds, where applicable, shall be processed within 7 working days.
Service availability may vary by station and location.

7. USER RESPONSIBILITIES & PROHIBITED USES

You agree not to use the Services for unlawful, harmful, fraudulent, or unauthorized purposes, including but not limited to: Tampering with or damaging EVSE equipment
Reverse engineering or attempting to hack the Application
Using the Services for unauthorized reselling or commercial exploitation
Uploading defamatory, obscene, or infringing content
Engaging in fraudulent transactions or impersonation

8. USER CONTENT & COMMENTS

Certain areas of our website/app allow users to post comments or feedback.
Comments do not represent the views of Chargeworks.
We reserve the right to monitor and remove content considered inappropriate, offensive, or in breach of these Terms.
By posting, you grant Chargeworks a non-exclusive license to use, reproduce, and display your content in any media.
You warrant that your content does not infringe third-party rights or contain unlawful material.

9. HYPERLINKING TO OUR CONTENT

Certain organizations may link to our website without prior approval (e.g., government agencies, search engines, news organizations).
Other organizations may request approval for linking. We reserve the right to approve or deny such requests.
Hyperlinks must not:
- Be deceptive or misleading

14. DISCLAIMER & LIMITATION OF LIABILITY

The Services are provided on an “as is” and “as available” basis.
We exclude all warranties to the maximum extent permitted by law.
Nothing herein shall limit liability for fraud, personal injury, or death caused by negligence.
Chargeworks shall not be liable for indirect, incidental, or consequential damages arising from use of the Services.
We shall not be liable for damages caused by:
User error while connecting to EVSE
Internet/power outages, connectivity failures, or government actions
Third-party service interruptions beyond our control

15. FORCE MAJEURE

We shall not be held liable for delays or failures caused by events beyond our reasonable control, including natural disasters, strikes, network outages, or government restrictions.

16. DISPUTE RESOLUTION

Any disputes shall first be attempted to be resolved amicably.
If unresolved, disputes shall be referred to arbitration under the Arbitration and Conciliation Act, 1996.
The seat and venue of arbitration shall be Bengaluru, Karnataka, India.

17. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of India.
Courts in Bengaluru, Karnataka shall have exclusive jurisdiction over disputes.
